DMCA Notice

This Digital Millennium Copyright Act (“DMCA”) Policy applies to the Toy Mail website (“Website” & “Service”) and outlines our procedures for addressing copyright infringement notifications.

Notification of Copyright Infringement

If you believe that material available on Toy Mail infringes on your copyright(s), you may send a written notice pursuant to the DMCA to our designated agent listed below. To be effective, your notification must include the following:

  1. Your physical or electronic signature;
  2. Identification of the copyrighted work you claim has been infringed;
  3. Identification of the material that you claim is infringing and that is to be removed, including a URL or specific location on our Website where the material is located;
  4. Your address, telephone number, and email address;
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement made under penalty of perjury that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Counter-Notification

If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification containing the following information:

  1. Your physical or electronic signature;
  2. Identification of the content that has been removed or disabled and the location at which the content appeared before it was removed or disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in your district (or if outside the U.S., that you consent to jurisdiction in any U.S. judicial district) and that you will accept service of process from the person who provided the original DMCA notification.

Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing may be subject to liability.

Repeat Infringers

Toy Mail reserves the right to terminate, in appropriate circumstances, users who are repeat infringers of intellectual property rights.

We may update this DMCA policy from time to time. Any changes will be posted on this page.
